policies. These Terms and condition of Use govern your use of this website,
content, software, firmware, and services offered through
NewElectronX.
By establishing a user account, accessing www.newelectronx.com, purchasing, or using NewElectronX
products to join the program and/or purchase items from our web site you
expressly acknowledge that you have read the policy terms, disclaimer, and conditions; and that you understand
and accept the terms, disclaimer, and conditions.
You accept, also, that we may change the terms and conditions at any time
without notice. You accept, further, that the site content, products, product
information, product availability and prices shown on our store may change at
any time.
Finally, you accept that you have evaluated the information
contained in these terms of use (policy), disclaimer, and conditions and in agreeing to become a
member and/or customer of the affiliates program, client program, or purchasing
buyer you are not relying on any other information other than that which is
contained in these terms, disclaimer, and
conditions.
NewElectronX does not sell products to children, but it
sells them to adults, who can purchase with a credit card. If you are under 18,

right to refuse service, terminate accounts, remove or edit content, or cancel
orders in their sole discretion.
Privacy: Any information given
to NewElectronX via help desk, email, mail, or any other method is kept strictly
confidential. This information will never be sold, leased, or given away to
anybody, and or any entities for statistical, advertising or any other reason
what-so-ever. Privacy is important to us, as it is important to our customers,

Tech Support / Manual download: You will receive technical
support on all items purchased. Support is provided for 30 days from the date of
purchase. Additional support can be purchased on some products, check your user
guide or manual to see if this applies to your item. If instructions are
available for your item then after purchasing you are welcome to download the
manuals within the specified number of days from your order date. The download
time or specified number of days is displayed on the confirmation page and in
your confirmation email after purchase. The guide will be in HIGH quality print
protected adobe .PDF format (Adobe 5.0 or higher required).
Our manuals,
guides, text, and tutorials (both online and offline) are
NO different from any other company who produces their
own text. All rights are reserved on our manuals, text, tutorials, and guides
that we produce. No part of our publication may be reproduced in any form or by

States Post Office money orders, and Western Union money orders only. If
the item is out of stock you have the option to wait till stock is replenished
or a full refund to the paid account prior to the order being shipped.

the same day (pending the confirmed payment arrives before 1 pm PST M - Fri,
Saturday before 8 am PST). Express mail orders must be placed before 11am M –
Fri only. All Sunday orders are mailed promptly on the following Monday. All

Packaging: Packages are professionally
packaged with certified USPS, FEDEX, or UPS materials and completely
insulated for safe delivery.
Options: Domestic (the lower 48
states) orders are shipped via Priority, First Class, Express Mail, UPS, or
FEDEX. International (world wide) orders are shipped via Express/Priority
Mail International, UPS, or FEDEX. These carrier selections are available
and governed by the purchaser choice at purchase; except in instances where
NewElectronX reserves the right to use Priority Mail for Express or USPS for
FEDEX / UPS (or vice versa).
Handling: Handling fees are
automatically calculated for all orders and displayed in the shopping
cart.
Insurance: Priority Mail, First Class Mail contains
absolutely NO shipping insurance. Please see Shipping Damage for further
details on what our shipping insurance consists of.
Tracking
numbers: (If applicable to the carrier selection at purchase) A parcel
number or tracking number will be added to the order status page / window
after shipment from NewElectronX Facility. Please note some carrier
selections offered by USPS DO NOT have a tracking number. USPS carrier
selections without tracking numbers contain a parcel number which is not
used for live tracking (while the parcel is in transit). Working tracking
numbers that show up to date progress of the package can be issued and used
with all UPS / FEDEX carrier selections or USPS Express Mail (which is very
limited).
Shipping Detail / Address: Note that we ship to the
billing address of the credit card used or an alternate ship to address on
file with your credit card and our Solicited payment provider companies (Pay Pal, Google Checkout, Bank Transfer, Money Orders (USPS Postmaster & Western Union)). Please contact the credit
card / solicited payment provider and request to list the shipping
address you want to receive products purchased on the internet as your
"alternate ship to address" prior to purchase or the address will be
consider void.
- If you would like to send the purchase as a gift, drop ship, or use an
alternate forwarder for shipping addresses that are not registered with your
credit card company / our solicited payment providers then kindly contact us
proir placing an order for other options available to this condition.
- All orders with void shipping addresses will be put ON-HOLD until
verified and subsequently cancelled / refunded within 48 hours if no action
is taken on your part.
- Please note that NewElectronX performs additional verification for
orders placed with different shipping and billing addresses prior to
shipment.
Shipping Damage: If you receive your
package and the box or package looks damaged please address this with the driver
and/or carrier delivering your package. Make sure you refuse the package and
have the driver send the package back to us. If the carrier driver leaves the
package at your delivery destination without initial notice to you then do not
open the package. Please take the package to your local delivery company and
send the package back to us. Please contact us immediately via the contact link
on our web site and tell us about the damaged package and when you refused it.
Please include original order id number and your name and complete address in
your contact with us. Also, please include an email address where we can contact
you regarding the damaged package. We require you to contact us within 3
business days of receipt of damaged product in order to file a claim. Most
delivery companies will return the package free of charge at their discretion.
We are not responsible for the shipping and/or handling in the event they refuse
a package for any reason. Generally if you do not tamper with the package then
they will send it back free of charge. You are responsible for any fees should
they apply. Upon receipt we will inspect the package and replace it at our
discretion.
Order Acceptance: Your receipt of an electronic or
other form of order confirmation does not signify our acceptance of your order,
nor does it constitute confirmation of our offer to sell. NewElectronX reserves
the right at any time after receipt of your order to accept or decline your
order for any reason (prior to shipment). NewElectronX further reserves the
right any time after receipt of your order, without prior notice to you, to
supply less than the quantity you ordered of any item. Your order will be deemed
accepted by NewElectronX upon shipment of the products or performance of
services that you have ordered. Title to goods passes to you upon delivery to
the common carrier. Orders placed over $1000.00 (U.S.) may require pre-approval
with an acceptable method of payment. We may contact you in this event. We may
require additional verifications or information before accepting any order.
NewElectronX is not responsible to sell mispriced products or services.
NewElectronX shall have the right to refuse or cancel any orders placed for
products and/or services listed at an incorrect price, rebate or refund, or
containing any other incorrect information or typographical errors. NewElectronX
shall have the right to refuse or cancel any such orders whether or not the
order has been confirmed and your credit card charged. If your credit card has
already been charged for the purchase and your order is canceled, NewElectronX
shall immediately issue a credit to your credit card account in the full amount
of the charge.
Risk of Loss: All items purchased from
NewElectronX are made pursuant to a shipment contract. This means that the risk
of loss and title for such items pass to you upon our delivery to the carrier.
NewElectronX will not be held responsible for any delays in shipments beyond its
control.
Chargeback: Chargeback’s are not necessary when ordering with NewElectronX. You are welcome to contact us directly via our Helpdesk Page if you need a refund or have any errors with our payment systems or order process. We can facilitate a refund quickly and hassle free without chargeback claims (if the order has not been shipped from our facility).
IMPORTANT: Misuse of our payment providers or other failure to comply with contacting us to request a refund will result in closure or suspension of your account with us. Additionally, anyone who submits a fraudulent claim or furnishes false or misleading information on a chargeback claim form may be subject to criminal and/or civil penalties, including fines and imprisonment.
These types of Chargeback’s are considered theft. We will take action in the event of chargeback’s to the greatest extent. Past chargeback attempts have incurred higher pay outs to various authorities exceeding the cost of the initial item. We are not responsible for any amounts due of you once action is taken. You are recommended to alert us by contacting us directly immediately at our helpdesk located on NewElectronX web site (newelectronx.com/contact.php) should you have any issues with your purchase and/or items. Other methods of contact are not recommended and will slow down any immediate resolutions to your issue. We will go through great lengths to ensure the issue is resolved amicably for both parties.
Warranty:
All products carry a 90 day warranty from the date of purchase from DEFECTS in
material and workmanship ONLY. Warranties are with the primary purchaser. The
warranty is void if the product is sold to another person or party. Altering,
removing any labels, disassembling equipment or soldering to IC pins, PCB
(board), or components will VOID the warranty. No warranty, either expressed or
implied covers the event of cable company system change. Intentional abuse is
not covered by this warranty. NewElectronX will not be responsible for any
damage caused as a result of installation or use of our products. All products
are to be used with NON CABLE COMPANY OWNED EQUIPMENT.
Return /
Refunds: Return policy is simple if you don't tamper with it, install it,
solder it, break it, dismantle it, or trim the wires you can return it, with the
exception to any microcontrollers or microchips. Customers must contact
NewElectronX via the helpdesk at newelectronx.com/contact.php to get a return
material authorization (RMA) number. There is a 25% restocking fee on all
returned items once it has been shipped from our facility. Shipping and Extended
Warranties is non refundable. Customers are responsible for all shipping costs:
initial purchase shipping / returns /exchange. No returns because your cable
company will not activate the cable box. No returns because of system
incompatibility. No returns because you do not know how to solder. No returns on
items that say all sales final. Items that are returned within 90 days will be
issued a full refunds less restock fee and shipping/handling. Items that are
returned greater than 90 days will receive a store credit less restock fee and
shipping/handling. All converter (except TriStar MX Nano) sales are final, no
returns unless determined by NewElectronX to be defective - if defective
exchange for same model number will be sent to you upon return of defective
converter. All returns must be shipped back with the same or equivalent shipping
materials. This includes the box and the internal packaging. All domestic
returns are to be shipped with USPS (United States Postal Service), no
exceptions. International buyers please contact us for details. Failure to
acknowledge and adhere to the return / refund portions of NewElectronX Policy
will be consider chargeback (please see chargeback for more
details).
User Responsibility: To purchase any goods and/or services on our website, you
must be at least eighteen (18) years of age or the applicable state age of
majority. Prior to the purchase of any goods or services on our site, you must
provide us with a valid associated personal and payment information. By
submitting that information to us, you hereby agree that you authorize us to
charge your card at our convenience but within thirty (90) days of credit card
authorization. We provide our users for an option of making payments via the
secure transaction systems of Pay Pal, Google Checkout, Bank Transfer, Money Orders (USPS Postmaster & Western Union).
Purchasers using the Pay Pal, Google Checkout, Bank Transfer, Money Orders (USPS Postmaster & Western Union)system are required to follow its terms
and conditions of use. It is the users/buyer's responsibility of reading and
understanding our shipping, warranty and return policies. The buyer is also
responsible for understanding the nature of our products, its specifications and
features.
You may use our products and services for lawful purposes
only. During your visit to our website and use of our services, you may not
engage in any conduct that: violates or infringes the rights of others
including, without limitation, patent, trademark, trade secret, copyright,
publicity or other proprietary rights; is unlawful, threatening, abusive,

sexual acts; victimizes, harasses, degrades, or intimidates an individual or

including NewElectronX and its employees and agents; contains viruses or any
other computer code, files or programs that interrupt, destroy or limit the
functionality of any computer software or hardware or telecommunications
equipment, or otherwise permit the unauthorized use of a computer or computer
network; encourages conduct that would constitute a criminal offense, or that
gives rise to civil liability; violates these Terms of Use, disclaimer,
guidelines or any policy posted on NewElectronX. You may not use NewElectronX or
its website in any manner that could damage, disable, overburden, or impair our
servers or networks. You may not attempt to gain unauthorized access to any of
our products, services, user accounts, computer systems or networks by any other
means than those authorized by NewElectronX. We may take any legal and technical
remedies to prevent the violation of this provision and to enforce these Terms
of Use, disclaimer, guidelines or any policy posted on NewElectronX.
Indemnification: You agree to indemnify and hold harmless
NewElectronX and its affiliates, service providers, vendors, resellers,
officers, directors and employees from any claim or demand, including reasonable
attorneys' fees, made by any third party arising out of or related to your
violation of this Terms of Use, disclaimer, guidelines, any policy posted on
NewElectronX, or your violation of any law, regulation or third-party right.
Proprietary Rights: We, our suppliers, and our users who lawfully
post text, messages, information, software/firmware, and/or images on our
website own the property rights to that content. Designated trademarks, brands
and All Rights Reserved items are the property of their respective owners.The
content is protected by international treaties, and by copyright, trademark,
patent, and trade secret laws and other proprietary rights. The look and feel of
our logo, color combinations, button shapes, and other graphical elements on our
website are our trademarks.
Your right to use our website
automatically terminates if you violate these Terms of Use or any rules or
guidelines posted in connection with NewelectronX. We also reserve the right, in
our sole discretion, to terminate your access to all or part of NewElectronX,
for any reason, with or without notice.
Your Account: If you
use this site, you are responsible for maintaining the confidentiality of your
account and password and for restricting access to your computer, and you agree
to accept responsibility for all activities that occur under your account or
password.
Affiliates Program: Your application to join the
program is considered in good faith. NewElectronX reserves the right to reject
any application if we deem it to be unsuitable for the program. We are not
required to give reasons for rejection but sites deemed unsuitable for inclusion
include those that,
1. Promote discrimination based upon race, gender,
religion, disability, age or sexual orientation.
2. Promote illegal
activities
3. Promote sexually explicit material
4. Promote violence
5.
Include material that violates the international intellectual property rights of
NewElectronX
Once a site has been accepted, NewElectronX reserves the
right at any time, and at our sole discretion, to terminate this agreement
should we deem your site to be no longer suitable for inclusion within the
affiliates program.
On acceptance into the program you will be given
access to specially adapted links that will refer visitors to our store, or
parts of our store, while at the same time allowing the program to accurately
track those visitors and calculate referral fees due to you. You must ensure
that each of the links between your site and our store properly use these
specially adapted links to .php. For example,
www.newelectronx.com/index.php?PARTNER=affiliate
Links other
than those specially adapted are not accepted and simply won't work. You will
only earn referral fees with respect to goods purchased at our store where
visitors have been referred using these specially adapted links.
NewElectronX will not be liable to you in any respect due to any failure
on your part to either properly use or correctly implement the specially adapted
links, including the fact that such failure to use or correctly implement the
specially adapted links results in a reduction in the referral fees that would
otherwise be due.
NewElectronX undertake to process orders placed by
customers to our store who have followed the specially adapted links from your
site. We reserve the right to reject any orders that do not comply with any
requirements in place at the time of your acceptance onto the affiliates program
and those requirements that we may periodically introduce.
NewElectronX
will undertake all aspects of order processing and order fulfillment.
NewElectronX store software will track, record and report all sales made
by customers to our store that have followed the specially adapted links from
your site. Reports summarizing this sales activity and calculating referral fees
due to you are available to you by logging on with your user name and password.
We reserve the right to vary the content and form of the information displayed
at any time and at our sole discretion.
Where a repeat customer at our
store has been established as having initially come to our store via the
specially adapted links on your site, referral fees are due on these repeat
purchases and they will be credited to your account. If a customer who initially
came to our store by following the specially adapted links on your site visits
our store on subsequent occasions, using specially adapted links on the site of
a third party associate to the program, then that customer ceases to be
considered eligible for repeat referral fees to your affiliate account, fees
then being due to the third party account.
Referral fees are due on
qualifying revenues. Qualifying revenues are determined as being derived from
sales exclusive of taxes and shipping costs.
Referral fees are
calculated in line with the current referral fee schedule. NewElectronX reserves
the right to change the referral fee schedule at any time and without prior
notice. We undertake to make the current referral fee schedule available when
you log on to your account.
Referral fees are calculated once an order
has been processed and fulfilled. Should an item be returned by a customer then
we will deduct the corresponding referral fee from your account. Should no
subsequent payment of referral fee be due to your account we will send you a
bill for the referral fee.
Referral fees will not be paid in the event
that the referral was made as a result of an unsolicited message or spam or
deliberate submission of linked pages to the search engines. In the event that
we are notified that unsolicited mailings have been made by an affiliate and
this is found to be proven we reserve the right to cancel that Affiliates
account without question or any further compensation.
Should a sale be
subject to a bad debt, for example if payment is subsequently reclaimed by our
credit card payment processor, money order, or the credit card issuing bank,
then we will deduct the corresponding referral fee from your account. Should no
subsequent payment of referral fee be due to your account we will send you a
bill for the referral fee.
Current referral fees due will be displayed
when you log on to your account. Commission due in any given month are only
calculated and displayed for that month once all orders placed in that month
have been fulfilled by the store.
Commission will be accrued in your
account until the threshold for payment has been reached. The threshold for
payment is displayed when you log on to your account. NewElectronX reserves the
right to alter the threshold for payment at any time and without prior notice.
Once referral fees due exceed the threshold, check payment will be made to you.
The Affiliates Program is a referral agreement between two commercial
organizations, yourselves and ourselves. As a bonus to our Affiliates the
account may be used to make personal purchases from your web site.
Customers buying product at our store will be considered to be our
customers. Accordingly all current procedures, rules prices, and policies in
operation at the store apply to those customers. NewElectronX reserve the right
to vary our policies, rules, prices and procedures at any time.
NewElectronX undertake to make all reasonable commercial efforts to
ensure that the information held on the store is accurate but we cannot be held
responsible for information as it applies to products displayed on the store.
NewElectronX reserve the right to change price and product information
on the store at any time. For this reason you must not display any product price
among the information displayed on your site.
The product images
displayed on our store are copyright of NewElectronX and/or their respective
manufacturers and cannot be copied or otherwise reproduced in whole or in part
for use on your site.
Links to our store must be in the form of the
specially adapted links available when you log in to your account. You may
provide one or more links to our store as below.
General Link
You may provide a specially adapted
link from your site to the home page of our store. We will provide the specially
adapted link when you log in to your account.
Product Links
You may use the specially adapted
links, along with a product catalog number, to link from your site to an
individual product in our store. We will provide the specially adapted link and
instructions on how to modify the link for each product, when you log in to your
account.
Search Links
You may use
the specially adapted links direct to the store search engine to allow visitors
to your site to search for products within our store. We will provide the
specially adapted link and instructions on how to implement the search link,
when you log in to your account.
We reserve the right to remove products
from our store at any time and without prior notice, and it is your
responsibility to ensure that the specially adapted links to individual products
are current and up to date.
We undertake to make available a number of
graphic images that identify your store as a participant in our affiliates
program and which will form part of the specially adapted links visitors from
your site to our store. You must display at least one of these images on your
site, or the store URL. We reserve the right to change the form and content of
the graphical images at any time. The graphic buttons available will be
displayed when you log in to your account.
The graphic images are made
available to you under license. The images must be used solely in connection
with this affiliates program and solely in order to identify your site as a
program partner. You may not alter the content or form of any of the graphic
images in any way. We reserve all rights in the graphic images, text, trademarks
and trade names, and all other intellectual property rights.
NewElectronX may revoke your license to use the graphic images and,
therefore, your membership of the program at any time by giving you written
notice.
You will be solely responsible for the development, operation
and maintenance of your site and all materials and content on your site. This
particularly applies to the effective establishment and continued maintenance of
the specially adapted links from your site to our store.
The terms of
this agreement begin once you receive confirmation from us that you have been
accepted onto the program. Either party, with or without cause, can terminate
the agreement at any time by giving written notice. As soon as the agreement is
terminated you will immediately stop using, and remove from your site, all links
to our store and any graphic or text reference that link you with the affiliates
program.
Referral fees are only due on sales occurring during the period
of the agreement. Any orders in progress at the time of the termination will be
fulfilled and referral fee calculated and added to your final payment. Final
payment may be delayed for a reasonable time to allow for any returns or bad
debt.
NewElectronX reserve the right to modify the terms and conditions
of this agreement at any time and without prior notice. Notice of changes made
will be posted on our store. If you are unhappy with any modifications made your
only recourse is to terminate this agreement. Your failure to provide written
notice to terminate the agreement following any change to the terms and
conditions will be taken as acceptance of those terms and conditions.
Acceptance onto the program does not constitute any partnership,
franchise, joint venture, sales representative or other employment relationship
between yourselves and ourselves. Acceptance onto the program does not give you
authority to accept any offers or make any representations on our behalf.
We reserve the right to accept web sites onto the program that may be
competitive with your own site. Further, we reserve the right to ourselves
operate web sites that are similar to, or which compete with, your web site.
NewElectronX will not be liable for any direct, indirect, special or
consequential damages, any loss of revenue, profits or data that may arise in
connection with this program. This applies even where we have been advised of
the possibility of such damages. Additionally our total liability with respect
to your participation in this program will not exceed the total referral fees,
paid or payable, to you.
NewElectronX make no express or implied
warranties or representations with respect to this program or with respect to
any of the products sold through our store, either as a result of this program
or separately.
While we make every effort to ensure continuous operation
and availability of the store we make no representation or guarantee that the
operation of the store will be either uninterrupted or error free. We will not
be liable for the consequences of any errors or interruptions.
Dealer
/ Wholesale Program (herein referred to as "client" or "client program" or
"program"): Your application to join the program is considered in good
faith. NewElectronX reserves the right to reject any application if we deem it
to be unsuitable for the program. We are not required to give reasons for
rejection.
You can become a client if you purchase our products
primarily for resale to consumers rather than for your own use. We reserve the
right to establish additional conditions that bona fide clients must meet and to
refuse client discounts to those clients that fail to meet them. In general, you
must:
1. Have experience selling consumer electronics.
2. Maintain a
monthly minimum order amount.
3. Have a ship-to address that UPS, FEDEX, or
USPS recognizes.
4. Be a store with customer hours, a catalog mailer with a
published catalog, or an internet marketer that owns a domain name and web site
offering our products for sale to end-user customers from your own
inventory.
5. Have a technical support or service department that can provide
support to your end users.
Once a client has been accepted, NewElectronX
reserves the right at any time, and at our sole discretion, to terminate this
agreement should we deem the client to be no longer suitable for inclusion
within the client program.
On acceptance into the program you will be
given access to exclusive prices and privileges. We reserve the right to reject
any orders that do not comply with any requirements in place at the time of your
acceptance onto the client program and those requirements that we may
periodically introduce. We reserve the right to vary the content and form of the
information displayed at any time and at our sole discretion.
The terms
of this agreement begin once you receive confirmation from us that you have been
accepted onto the program. Either party, with or without cause, can terminate
the agreement at any time by giving written notice. As soon as the agreement is
terminated you will immediately stop using your login privileges, and you will
be removed from the client program.
NewElectronX reserve the right to
modify the terms and conditions of this agreement at any time and without prior
notice. Notice of changes made will be posted on our store. If you are unhappy
with any modifications made your only recourse is to terminate this agreement.
Your failure to provide written notice to terminate the agreement following any
change to the terms and conditions will be taken as acceptance of those terms
and conditions.
Acceptance onto the program does not constitute any
partnership, franchise, joint venture, sales representative or other employment
relationship between yourselves and ourselves. Acceptance onto the program does
not give you authority to accept any offers or make any representations on our
behalf. We reserve the right to accept clients onto the program that may be
competitive with your company.
NewElectronX will not be liable for any
direct, indirect, special or consequential damages, any loss of revenue, profits
or data that may arise in connection with this program. This applies even where
we have been advised of the possibility of such damages.
